1. Agreement to Terms

By accessing or using SurpriseHub ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

SurpriseHub is a web-based platform that allows users to create personalised, animated surprise pages for birthdays, valentines, anniversaries, and other celebrations. Users can customise themes, upload media, set countdowns, and share unique links with recipients.

3. User Accounts

  • •You must be at least 13 years old to create an account.
  • •You must provide accurate and complete registration information.
  • •You are responsible for maintaining the security of your account credentials.
  • •You are responsible for all activities that occur under your account.
  • •You must notify us immediately of any unauthorised access to or use of your account.

4. Subscriptions & Payments

  • •SurpriseHub offers subscription-based plans ("Day", "Week", and "Month") with varying features and surprise token allowances.
  • •Payments are processed through Paystack in KES (via M-Pesa mobile money) or USD (via card/bank transfer/Apple Pay). By subscribing, you authorise the applicable charges in your chosen currency.
  • •Surprise links remain active for the duration specified by your plan (e.g. 24 hours + 4-hour grace for Day plans, 7 days + 1-day grace for Week plans, 30 days + 7-day grace for Month plans).
  • •Subscription tokens stack if you purchase multiple plans while existing subscriptions are still active.
  • •Refunds are handled on a case-by-case basis. Contact support within 24 hours of purchase if you experience issues.

5. Acceptable Use

You agree not to use the Service to:

  • ✕Upload content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
  • ✕Impersonate any person or entity or misrepresent your affiliation.
  • ✕Upload malware, viruses, or any destructive code.
  • ✕Attempt to reverse-engineer, hack, or compromise the security of the Service.
  • ✕Use automated bots or scrapers to access the Service.
  • ✕Upload content that infringes on intellectual property rights of others.

6. User Content

  • •You retain ownership of any content you upload ("User Content"), including images, videos, audio, and text.
  • •By uploading User Content, you grant SurpriseHub a non-exclusive, worldwide, royalty-free licence to host, display, and distribute your content solely for the purpose of providing the Service.
  • •Media files are stored via Cloudinary. We are not responsible for Cloudinary's data handling practices beyond our integration.
  • •We reserve the right to remove any User Content that violates these Terms without notice.

7. Intellectual Property

The Service, including its original content, features, functionality, design, and branding (excluding User Content), is owned by SurpriseHub and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works of any part of the Service without our prior written consent.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

9. Termination

  • •You may delete your account at any time from your dashboard settings. Upon deletion, all your surprise pages, media, analytics, and personal data will be permanently removed.
  • •We may suspend or terminate your account if you violate these Terms, with or without notice.
  • •Upon termination, your right to use the Service ceases immediately. Surprise pages associated with your account will no longer be accessible.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SURPRISEHUB AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
